Our framework for acceptable behaviour and reporting mechanisms

The purpose of the Code of Conduct is to ensure that Danida Fellowship Centre’s staff and partners, and participants in Danida Fellowship Centre funded activities have guidelines for what to do if they encounter sexual or physical assault, exploitation, harassment, corruption, child labour, or the planning of, or incitement to, terror.

The Danida Fellowship Centre Code of Conduct provides the framework for acceptable behaviour and explains the reporting mechanisms.
The Code of Conduct is in accordance with the Danish Ministry of Foreign Affairs’ (MoFA) requirements for conduct in Danida-financed activities and it covers the following areas:

I. Protection from Sexual Exploitation, Abuse and Harassment (PSEAH)

Everyone has the right to a life free of sexual exploitation, abuse and harassment. Danida Fellowship Centre has zero tolerance for the violation of this right. Danida Fellowship Centre does not tolerate sexual exploitation, abuse and harassment, neither internally in the organisation nor externally among partners, external actors or participants in Danida Fellowship Centre funded activities.

Danida Fellowship Centre has zero tolerance for sexual exploitation, abuse and harassment.

Danida Fellowship Centre will actively prevent sexual exploitation, abuse and harassment (PSEAH) and ensure, in the best possible way, that Danida Fellowship Centre activities are always carried out in an environment free of all kinds of exploitation, abuse and harassment, sexual or otherwise, and are mindful of particularly vulnerable groups.

Danida Fellowship Centre supports an open and safe environment for staff, partners and participants in Danida Fellowship Centre funded activities. It is the overall responsibility of the Danida Fellowship Centre management team to ensure transparency and compliance with the Code of Conduct and reporting mechanisms. It is the responsibility of the Danida Fellowship Centre management team to ensure that all Danida Fellowship Centre staff adhere to the Code of Conduct.

To clarify Danida Fellowship Centre’s zero tolerance for sexual exploitation, abuse and harassment, and to hold partners accountable to the principle of fighting against sexual harassment, all agreements with partners and subgrantees must contain a clause in which partners and subgrantees are made aware of, and agree to, the zero-tolerance policy:

“The Danish MoFA has a zero tolerance for inaction approach to tackling sexual exploitation, abuse and harassment (SEAH) as defined in UNSG Bulletin ST/SGB/2003/13 and the definition of sexual harassment in UNGA Resolution A/RES/73/148. The Implementing Partner, and its sub-grantees, will take appropriate measures to protect people, including beneficiaries and staff, from SEAH conducted by its employees and associated personnel including any sub-grantee staff and take timely and appropriate action when reports of SEAH arise. In the event that the Implementing Partner receives reports of allegations of SEAH, the Implementing Partner will take timely and appropriate action to investigate the allegation and, where warranted, take disciplinary measures or civil and/or criminal action. Any violation of this clause will be ground for the immediate termination of this Agreement.”

Within the organisation
If a member of staff experiences, or is made aware of, any SEAH conduct within Danida Fellowship Centre, the staff member must immediately contact the Danida Fellowship Centre work environment representative (AMR) or a member of the Danida Fellowship Centre management team.

If a concern has been raised with the AMR, the AMR must take the concern to a member of the Danida Fellowship Centre management team or to a member of the Danida Fellowship Centre board.

The management team must investigate the incident and take appropriate action against the perpetrator.

Outside the organisation
If a Danida Fellowship Centre staff member experiences, or is made aware of, SEAH conduct towards a Danida fellow, a partner or an external collaborator, the member of staff must immediately contact a member of the Danida Fellowship Centre management team.

If a Danida fellow experiences or is made aware of SEAH conduct towards a Danida fellow or partner, or toward a Danida Fellowship Centre staff member, the Danida fellow is strongly encouraged to immediately contact a member of the Danida Fellowship Centre staff or management team.

The management team is always ready to receive and act on SEAH complaints from participants and partners in Danida Fellowship Centre funded activities.

The management team must investigate the incidents and take appropriate action against the perpetrators of SEAH.

II. Anti-corruption

Corruption is defined as ‘the abuse of entrusted power for personal gain’. There are many kinds of abuse related to corruption, including a conflict of interest, bribery, extortion, fraud, embezzlement, gifts, nepotism and favouritism.

Danida Fellowship Centre has zero tolerance for corruption. Openness and transparency are key factors to ensure compliance with a zero-tolerance policy against corruption.

The Danida Fellowship Centre management team must ensure that all staff members are familiarised with the anti-corruption policy through internal instructions and policies, such as the Staff Handbook. It is the responsibility of Danida Fellowship Centre’s management team to ensure that all Danida Fellowship Centre staff adhere to the Code of Conduct.

To clarify Danida Fellowship Centre’s zero tolerance for corruption and to hold partners accountable to the principle of fighting against corruption, all agreements with partners and subgrantees must contain a clause in which partners and subgrantees are made aware of, and agree to, the zero-tolerance policy:

”No offer, payment, consideration or benefit of any kind, which could be regarded as an illegal or corrupt practice, shall be made – neither directly nor indirectly – as an inducement or reward in relation to tendering, award of the contract, or execution of the contract. Any such practice will be grounds for the immediate cancellation of this contract and for such additional action, civil and/or criminal, as may be appropriate. At the discretion of the Danish Ministry of Foreign Affairs, a further consequence of any such practice can be the definite exclusion from any tendering for projects, funded by the Danish Ministry of Foreign Affairs.”

Within the organisation
Any staff member who suspects, or gains knowledge about, corruption involving other members of staff, collaboration partners, project partners or other actors, is obligated to immediately notify the Danida Fellowship Centre management team or a member of the Danida Fellowship Centre board.

If there is any suspicion of, or knowledge of concrete cases of corruption, Danida Fellowship Centre’s management team or staff must notify MoFA. This approach applies to cases in Denmark and abroad, regardless of the source of suspicion or knowledge.

Outside the organisation
The MoFA Danida Anti-Corruption hotline offers collaboration partners and participants in Danida-funded activities a hotline to report suspicions of financial abuse within Danida-funded programmes and projects.

III. The fight against child labour

According to the International Labour Organisation, there are currently 138 million girls and boys engaged in child labour that is mentally, physically, socially or morally dangerous. Child labour makes it difficult for a child to attend school, or limits their attendance, and children who perform child labour are less inclined to complete primary schooling.

Danida Fellowship Centre has zero tolerance for child labour.

Child labour is therefore never accepted in any Danida Fellowship Centre related activity or any project with collaboration partners or external actors. It is the responsibility of the Danida Fellowship Centre management team to ensure that all Danida Fellowship Centre staff adhere to the Code of Conduct.

To clarify Danida Fellowship Centre’s zero tolerance towards child labour, and to hold partners accountable to the principle of fighting against child labour, all agreements with partners and subgrantees must contain a clause in which partners and subgrantees are made aware of and agree to the zero-tolerance policy:

“The Implementing Partner shall abide by applicable national laws as well as applicable international instruments, including the UN Convention on the Rights of the Child and International Labour Organisation conventions. Any violation will be ground for immediate termination of the Agreement.”

If child labour of any kind is detected in a Danida Fellowship Centre funded programme or project, Danida Fellowship Centre must be informed immediately.

Furthermore, the relevant collaborating partner must ensure the initiation of interventions that support solutions in the best interests of the child, taking into consideration the age, social situation and level of schooling of the child.

If a child in employment has to be replaced by an adult, the job must be offered to a member of the child’s household who must be paid at least the minimum wage to ensure financial stability for the child and the child’s family.

All collaboration with partners refusing to adhere to these guidelines will be terminated/reviewed immediately.

IV. Anti-terror

Danida Fellowship Centre and Implementing Partners (including contractors, subcontractors and subgrantees) must take all reasonable steps to secure that no transaction made in relation to the Danida Fellowship Centre funded project/programme will – directly or indirectly – benefit a person, group or entity subject to restrictive measures (sanctions) by the UN or the EU.

Danida Fellowship Centre has zero tolerance for terrorism or terror-related activities.

Danida Fellowship Centre staff must know and accept the Danida Fellowship Centre zero-tolerance policy on terrorism or terror-related activities. It is the responsibility of the Danida Fellowship Centre management team to ensure that all Danida Fellowship Centre staff adhere to the Code of Conduct.

To clarify Danida Fellowship Centre’s zero tolerance for terrorism and terror-related activities, and to hold partners accountable to the principle of fighting against terrorism and terror-related activities, all agreements with partners and subgrantees must contain a clause in which partners and subgrantees are made aware of, and agree to, the zero-tolerance policy:

“If, during the course of implementation of this Project/Programme, the Implementing Partner discovers any link whatsoever with any organization or individual associated with terrorism, it must inform the Danish MoFA immediately and explain the reasons for such transfer, including whether it was made or provided knowingly, voluntarily, accidentally, unintentionally, incidentally or by force. The Implementing Partner agrees that it and/or its implementing partners (including contractors, sub-contractors and sub-grantees) will take all reasonable steps to secure that no transaction made in relation to the Project/Programme will – directly or indirectly – benefit a person, group or entity subject to restrictive measures (sanctions) by the UN or the EU. Any violation of this clause is ground for immediate termination of the Agreement returning to the Danish MoFA of all funds advanced to the Implementing Partner under it.”

Danida Fellowship Centre must be immediately informed if there is a suspicion of any link whatsoever between a Danida Fellowship Centre funded activity and an organisation or individual associated with terrorism. Danida Fellowship Centre must be immediately informed if terrorism or terror-related activities of any kind are detected in Danida Fellowship Centre funded activities or in relation to Danida Fellowship Centre funded activities.

In the event of a suspicion of, or knowledge about, terrorism or terror-related activities, the Danida Fellowship Centre management or staff must notify MoFA. This approach applies to cases in Denmark and abroad, regardless of the source of the suspicion or knowledge.
